*With regard to vacancy allowance increases, as a result of amendments to the rent stabilization laws which took effect June 15, 2015, where the tenant who vacated the apartment was paying a preferential rent, the vacancy allowance is as follows:
5% if the last vacancy lease commenced less than two years ago,
10% if the last vacancy lease commenced less than three years ago,
15% if the last vacancy lease commenced less than four years ago, and
20% if the last vacancy lease commenced four or more years ago. The vacancy allowances are applied to legal regulated rent, not the preferential rent.

LUXURY DEREGULATION THRESHOLD:
Pursuant to the Rent Act of 2015, the Deregulation Threshold for Luxury Deregulation is increased by the amount of the one year guideline. Accordingly, the existing Deregulation Threshold for New York City becomes $2,774.75 effective January 1, 2019.

Between $300 and $500, the increase is the greater of the percentage increase or $100.  The renewal guidelines do not apply on vacancy.

The vacancy allowances are applied to legal regulated rent, not the preferential rent.

LUXURY DEREGULATION THRESHOLD:
Pursuant to the Rent Act of 2015, the Deregulation Threshold for Luxury Deregulation is increased by the amount of the one year guideline. Accordingly, the existing Deregulation Threshold for New York City becomes $2,733.75

Where Heat is Provided by the Owner:

For a one-year renewal lease : 3%

For a two-year renewal lease : 6%

 

If the most recent vacancy lease was executed six years or more prior to the date of the renewal lease under this Order, the following shall instead apply:

For a one-year renewal lease : 3% or $30, whichever is greater.

For a two-year renewal lease : 6% or $60, whichever is greater.

 

Where heat is Not Required to be Provided by the owner:

For a one-year renewal lease : 2.5%

For a two-year renewal lease : 5%

 

If the most recent vacancy lease was executed six years or more prior to the date of the renewal lease under this Order, the following shall instead apply:

For a one-year renewal lease : 2.5% or $25, whichever is greater.

For a two-year renewal lease : 5% or $50, whichever is greater.

 

There is no low rent supplement

For a two-year renewal lease : 8.5%

 

If the most recent vacancy lease was executed six years or more prior to the date of the renewal lease under this Order, the following shall instead apply:

For a one-year renewal lease : 4.5% or $45, whichever is greater.

For a two-year renewal lease : 8.5% or $85, whichever is greater.

 

Where heat is Not Required to be Provided by the owner:

For a one-year renewal lease : 4.0%

For a two-year renewal lease : 8.0%

 

If the most recent vacancy lease was executed six years or more prior to the date of the renewal lease under this Order, the following shall instead apply:

For a one-year renewal lease : 4.0% or $40, whichever is greater.

For a two-year renewal lease : 8.0% or $80, whichever is greater.

 

Adjustments for renewal leases shall also apply to dwelling units in a structure subject to the partial tax exemption program under Section 421a of the Real Property Tax Law, or in a structure subject to Section 423 of the Real Property Tax Law as a Redevelopment Project.
